Village Zoning Board of Appeals
New York State Village Law, sections 7-712 & 7-718, establishes the laws that govern the performance of combined Planning & Zoning Boards for New York State Villages. The Webster Village Zoning Board of Appeals consists of five members and two alternates selected by the Webster Village Board from village residents who are older than 18 years and US citizens. The Zoning Board members complete formal courses in Land Use Law and attend various seminars to keep current in new developments relative to zoning issues. Like all boards, the Zoning Board has an attorney assigned to it, to help guide the board in their decision making process.
The Zoning Board rules on: Variance Requests, Subdivision Regulations, Zoning Changes, Site Plan Regulation, Capital Budgets,
Recreation Studies, and last but not least it determines compliance with the Comprehensive Plan.
The Comprehensive Plan is a document created by the residents of the Village of Webster and adopted by the Village Board which expresses the community goals and recommended actions to achieve those goals. It focuses on both short term and long term protection, enhancement, growth and development of the village, and provides guidance for the decision-making to achieve those goals.
The Zoning Board, as stated previously, also regulates. It is authorized by the elected Village Board to regulate the following: Sign Permits, Issuance of Special Use Permits, Site Plan Review, Historic Preservation, Architectural Review, Subdivision Review. The Webster Village Code provides laws governing the conduct of the Zoning Board.
To guide our community's future development of the Village Zoning Board of Appeals, established zoning laws and ordinances. Some of the provisions are intended to provide adequate light, air, and convenience of access, to secure safety from fire and other hazards and to prevent undue concentration population by regulating and limiting the height and bulk of buildings, limiting and specifying the size yards, courts and other open spaces, controlling the density of population and regulating and restricting location of trades, industries and buildings designed for a specific use.
The Zoning Board typically meets on the third Tuesday of each month at 7:00 PM in the Community Meeting Room for a formal session to conduct a public hearing to accomplish the above "advise and regulate" responsibilities. Additionally there are informal meetings from time to time when necessary, which are also open to the public. We encourage all residents to attend these meetings as it is an excellent way to familiarize yourself with the functions of the Zoning Board of Appeals.
