RESOLUTION 2010-44 NOTICE OF 2010 ANNUAL ELECTION
NOTICE IS HEREBY GIVEN by the undersigned that the 2010 Annual Election of Officers in the North East Joint Fire District, comprising portions of the Towns of Penfield and Webster, Monroe County, New York, will be held on the 14th day of December, 2010 to elect one (1) Fire Commissioner for a term of five (5) years, such term is to commence on January 1, 2011. The Fire District Commissioner, at the time of his/her election, must be a resident elector in the North East Joint Fire District and during his/her term of office.
NOTICE IS FURTHER GIVEN that such election will be held at the North East Joint Fire District Enderlin Station at 35 South Avenue, in the Village of Webster, New York on the 14th day of December, 2010, from 6:00 o'clock p.m. until 9:00 o'clock p.m., prevailing time, during which time, the polls will remain open for the receipt of ballots. All duly registered electors in the North East Joint Fire District of the Towns of Penfield and Webster who have been registered voters prior to November 23, 2010 are qualified to vote at such election.
NOTICE IS FURTHER GIVEN that any candidate for the office of Fire Commissioner who desires to have his/her name appear on the official ballot for such office shall file his/her name with the Secretary of the Fire District by filing a Petition subscribed by twenty-five (25) qualified voters of the Fire District, at least twenty (20) days prior to December 14, 2010, to wit: on or before November 24, 2010.

NOTICE OF PUBLIC HEARING ON THE ANNUAL BUDGET |
PLEASE TAKE NOTICE, that the Board of Fire Commissioners of the North East
Joint Fire District located in the Towns of Penfield and Webster and in the Village of Webster, in
the County of Monroe, State of New York shall present the Proposed Budget of the North East
Joint Fire District and to discuss the contents of the same.
Pursuant to Town Law §105, a PUBLIC HEARING will be held at 7:30 o’clock p.m.
prevailing time on October 19, 2010 at North East Joint Fire District Roseland Station. Meeting
Room, 1391 Salt Road, in the Town of Penfield, New York 14580.
The purpose of the public hearing is to allow any person to be heard in favor of or against

NOTICE OF PUBLIC HEARING
Notice of the adoption of Webster Business Improvement District Plan and Notice of Public Hearing.
The Village Board of the Village of Webster will hold a Public Hearing regarding the establishment of a new Village of Webster Business Improvement District on September 23, 2010 at 7:45 PM in the Community Meeting Room, 29 South Avenue, Webster, New York.
Additionally, the following is a summary of a Resolution adopted by the Webster Village Board on August 26, 2010:
The District Plan for the Village of Webster Business Improvement District is presently on file in the Village Clerk’s Office at 28 West Main Street, Webster, New York for public inspection. Copies of the full text of the Village Board’s Resolution adopting the District Plan are available, free of charge to the public from the Village Clerk’s Office. Said Resolution includes a copy of the District Plan.
The proposed improvements that are to be provided pursuant to the District Plan include, but are not limited to, the following:
- Parking Improvements to increase parking supply, enhance pedestrian traffic and connections, increase awareness through signage and improve overall parking management;
- Street and sidewalk amenities to improve pedestrian circulation and identify and enhance the district;
- Coordination of planting trees and flowers and other vegetation and green areas within the district;
- Development of unified logos, plaques, decorative pavers, furniture and lighting;
- Coordinating banners, signs, flags and decorations to promote the district during special holidays and events;
- Development of public spaces for district activities such as open-air markets and passive recreational uses.
The cost of these improvements shall be covered on an on-going as-needed basis and the proposed first year annual budget for the district is proposed to be twenty-five thousand dollars ($25,000).
Please take further notice that any owner of real property located within the proposed BID, who is therefore deemed benefitted by its establishment and who wishes to object to the BID’s formation, must file a written objection, on forms provided by the Village Clerk, in the office of the Village Clerk within thirty (30) days of the conclusion of the Public Hearing.
Further, the BID will not be established if written objections are filed from:
- The owners of at least fifty-one percent (51%) of the assessed valuation of all the benefitted real property situated within the proposed BID boundaries, as shown upon the municipality’s most recently completed assessment roll (and not including tax-exempt properties which will not benefit by the BID); or
- At least fifty-one percent (51%) of the owners of benefitted real property within the proposed BID boundaries (not including tax exempt properties that will not benefit by the BID).

The Village Board of the Village of Webster will hold a Public Hearing regarding hours of operation with the Village of Webster Parks on Thursday, September 9, 2010 at 7:45 pm in the Community Meeting Room, 29 South Ave. Public comment will be welcome at that time.
Park hours that will be considered are as follows:
All Village parks will be closed one half hour after sunset and remain closed until sunrise the next day; unless an official BID or Village eent is scheduled.

The Village Board of the Village of Webster will hold a Public Hearing regarding the Village of Webster Code of Ethics on August 26th 2010 at 7:45pm in the Community Meeting Room, 29 South Ave.
VILLAGE OF WEBSTER CODE OF ETHICS
The Village of Webster was incorporated in 1905. It grew slowly for the next fifty years. Since 1955 substantial and rapid growth has come to the Village in its residential and industrial areas. Its service functions have greatly increased. It has many more employees and much more property and equipment. Its budget and assessment rolls have become large financial matters.
The Legislature of New York State, by Chapter 1019 of the laws of 1970,· required all villages to adopt a Code of Ethics setting forth for the guidance of its officers and employees the standards of conduct reasonably expected of them. In order to carry out this statutory requirement, and to insure the continuance of the present high standards of service of the Village's employees, the Board of Trustees hereby adopts the following resolution:
RESOLVED by the Board of Trustees of the VILLAGE OF WEBSTER, Monroe County, New York, hereafter called "Village", as follows:
Section 1. Pursuant to the provisions of Section 806 of the General Municipal Law, the Village recognizes that there are rules of ethical conduct for public officers and employees which must be observed if a high degree of moral conduct is to be maintained and if public confidence is to be maintained in our unit of local government. It is the purpose of this resolution to promulgate these rules of ethical conduct for the officers and employees of the Village. These rules shall serve as a guide for official conduct of the officers and employees of the Village. The rules of ethical conduct of this resolution as adopted shall not conflict with, but shall be in addition to any prohibition of Article eighteen of the General Municipal Law or any other general or special law relating to ethical conduct and interest in contracts of municipal officers and employees.
Section 2. Definitions.
(a) "Municipal officer or employee" means an officer or employee of the Village, whether paid or unpaid., including members of any administrative board, commission or other agency thereof.
(b) “Interest” means a pecuniary or material benefit accruing to a municipal officer or employee, unless the context otherwise requires, his or her spouse or dependents, or a business organization of which he is a member, officer or employee, or of which he owns, directly or indirectly, 5% or more.
Section 3. Standards of Conduct. Every officer or employee of the Village shall be subject to and abide by the following standards of conduct:
(a) Gifts. He or she shall not, directly or indirectly, solicit any gift, whether in the form of money, services, loan, travel, entertainment, hospitality, thing or promise, or any other form, under circumstances in which it could reasonably be inferred that the gift was intended to influence him or her or could reasonably be expected to influence him or her in the performance of his or her official duties, or was intended as a reward for any official act on his part. He or she shall not, directly or indirectly, accept or receive any gift having a value of $75.00 or more, whether in the form of money, services, loan, travel, entertainment, hospitality, thing or promise, or any form, under circumstances in which it could be reasonably inferred that the gift was intended to influence him or could be reasonably expected to influence him in the performance of his duties, or was intended as a reward for any official action on his part.
(b) Confidential information. He or she shall not disclose confidential information acquired by him in the course of his official duties or use such information to further his personal interest.
(c) Representation before one's own agency. He or she shall not receive, or enter into any agreement, express or implied, for compensation for services to be rendered in relation to any· matter before any agency of his municipality, Whereby his or her compensation is to be dependent or contingent upon any action by such agency with respect to such matter, provided that this paragraph shall not prohibit the fixing at any time of fees based upon the reasonable value of the services rendered.
(d) Disclosure of interest in legislation. To the extent that he knows thereof, a member of the Board of Trustees and any officer or employee of the Village, whether paid or unpaid, who participates in the discussion or gives official opinion to the Village on any matters before the Board, shall publicly disclose on the official record the nature and extent of any direct or indirect financial or other private interest he has in such matters. Actual entry in the official minutes of the disclosure of interest will suffice.
(e) Investments in conflict with official duties. He or she shall not invest or hold any investment directly or indirectly in any financial, business, commercial or other private transaction which creates conflict with his official duties.
(f) Private employment. He or she shall not engage in, solicit, negotiate for or promise to accept private employment or render services for private interests when such employment or service creates a conflict with or impairs the proper discharge of his official duties.
(g) Future employment. He or she shall not, after the termination of service or employment with such municipality, appear before any board or agency of the Village in relation to any case, proceeding or application in which he or she personally participated during the period of his or her service or employment or which was under his or her active consideration.
Section 4. Nothing herein shall be deemed to bar or to prevent the timely filing by present or former municipal officer or employee of any claim, account, demand or suit against the Village, or any agency thereof, on behalf of himself or herself or any member of his family, arising out of any personal injury or property damage or for any lawful benefit authorized or permitted by law.
Section 5. Distribution of Code of Ethics.
The Clerk of the Village shall cause a copy of this Code of Ethics to be distributed to every officer and employee of the Village within ten days after the effective date of this resolution. Each officer and employee elected or appointed thereafter shall be furnished a copy before entering upon the duties of his office or employment.
Section 6. The Clerk of the Village shall file a copy hereof in the office of the State Comptroller Within thirty days after adoption.
Section 7 Penalties
In addition to any penalty contained in any other provision of law, any person who shall knowingly and intentionally Violate any of the provisions of this Code may be fined, suspended or removed from office or employment, as the case may be, in the manner provided by law.
Section 8 Board of Ethics
A. Membership. There is hereby established a Board of Ethics consisting of three members, appointed by the Mayor with the approval of the Board of Trustees, all of whom shall reside in the Village of Webster and who shall serve without compensation for a term of one year. One member of the Ethics Board shall be a member of the Village Board, one member an employee of the Village other than a member of any appointed or elected Village Board and one member shall be a resident of the Village.
B. Advisory opinions. The Board of Ethics established hereunder shall render advisory opinions to Village employees on written request and upon request of the Board of Trustees of the Village of Webster make recommendations to such Village Board. The opinions of the Board of Ethics shall be advisory and confidential and in no event shall the identity of the Village employee be disclosed except to authorized persons and agencies. Such opinions shall be on the advice of counsel employed by the Board of Ethics or, if none, of the Village Attorney.
C. Rules and regulations. Such Board of Ethics upon its formation shall promulgate its own rules and regulations as to its form and procedures and shall maintain appropriate records of its opinions and proceedings.
Section 9. Effective date. This resolution shall take effect ten (10) days after it is adopted.
Public comments will be welcomed and considered.
